What is Citizenship amendment bill??
Citizenship act 1955 regulates that on what grounds citizens of other country should get citizenship in India. The bill was presented in Lok Sabha in 2016 which amends the citizenship act 1955. It was refereed to joint parliamentary committee which submitted its report on 7th Jan 2019 & passed by Lok Sabha on 8th Jan 2019 but bill lapsed due to dissolution of Lok Sabha.
A person may become an Indian citizen if they are born in India or have Indian parentage or have resided in the country for a period of time. However, illegal migrants are prohibited from acquiring Indian citizenship. An illegal migrant is a foreigner who: (i) enters the country without valid travel documents, like passport and visa, or (ii) enters with valid documents, but stays beyond the permitted time period. The Bill amended the Act to provide that Hindus, Sikhs, Buddhists, Jains, Parsis and Christians from Afghanistan, Bangladesh and Pakistan will not be treated as illegal migrants who arrived in India on or before 31st December 2014. All legal prepossessing against these illegal migrants shall be closed. The Act provides that the central government may cancel registration of OCIs on five grounds including registration through fraud, showing disaffection to the Constitution, engaging with the enemy during war, necessity in the interest of sovereignty of India, security of state or public interest, or if within five years of registration the OCI has been sentenced to imprisonment for two years or more. The Bill added one more ground for cancelling registration, that is, if the OCI has violated any law that is in force in the country.
As more percentage of hate crimes,religion conversion,rapes and many other crimes against the minority are growing at exponential rate in these three countries. Cases of killing of atheists by Islamic militants are well-documented. While Shah claimed that “persecution has been rampant since the death Sheikh Mujibur Rehman”.
So our government came to rescue them and decide to take this historic decision.
The government of India didn’t took much time to pass this bill. Government cannot provide safeguard to our own citizens as crime against women is growing day by day like hate crimes against SC & ST, Riots and many more. Moreover government is also not able to take down issues like Economic crash down, jobs, poverty etc. How can they be able to handle more people from other country?
Protest In Assam,Delhi & other parts
Assam is protesting as they are worried about vanishing their own culture, language, heritage as there are thousands of Illegal Migrants who will get citizenship due to passing of this bill. Assamese will become minority in their own state. Assam resources are already being exploited by Illegal migrants from Bangladesh since 1971 & now they will get an open hand to use their resource claim as their right over jobs, education which is primarily right of Assamese people. The protesters argument is that the new law violates the Assam Accord of 1985. Also no national media coverage about their voice ever got concerned. However, Home Minister assured that Assam’s culture would be protected under Clause 6 of the Assam Accord.
Protests in Delhi is dominated by Muslim groups. They had the feeling that the articles violate Article 14 of Constitution. Moreover Government Of India is planning to bring NRC all over country. Plugged with NRC, the new amendment becomes an enabling law to potentially disenfranchise muslims for not mentioning in the list. Politically, it will influence the polls in Assam, WB and Andhra Pradesh. Protests in other parts can also be influenced by opposition and individual groups. Protest march turned violent, police got beaten up in many places, Internet shutdown took place in many parts of India as the outbreak of protests expanded.
The parliament has passed the bill. It also not dismissed by Supreme Court so if people didn’t like the bill they can continue to do peaceful protest but they should not get into web of false rumors. The bill is not against muslims of India, it will only provide Indian Citizenship to minority in 3 country who has faced discrimination since independence.However if CAA twinned with NRC it can be great difficulty not only for muslims but also for poor nationals. Besides this cost of conducting NRC will be too high coupled with demotivated and corrupt government officials.
